Terms of Service
Effective 11 October 2026
These Terms of Service ("Terms") set out the agreement between you and Lekt Software OÜ for the use of Air9, a service available at air9.cloud, together with any associated apps, software and websites (together, the "Services"). By creating an account, making a purchase or otherwise using the Services, you agree to be bound by these Terms, including any changes made to them in accordance with these Terms. Our affiliates, licensors, distributors and service providers (collectively, "Providers") are not contracting parties under these Terms.
In these Terms, "we", "us" and "our" mean Lekt Software OÜ. Words in quotation marks have the meaning given to them where they are first used.
1. General
1.1. Use of Air9 by anyone under 13 years of age is prohibited. You represent that you are at least the age of majority in the jurisdiction where you live or, if you are not, that your parent or legal guardian has consented to these Terms and accepts them on your behalf and bears responsibility for your use. Outputs of AI models accessed through Air9 may not be suitable for minors. If you accept these Terms on behalf of someone else or an entity, you confirm that you have the legal authority to bind that person or entity.
1.2. To access most of the Services, we ask you to create an account (your "Account") and to provide certain information, such as your email address. You may sign in with an email address and password or through a third-party identity provider such as Google. You agree to provide correct, current and complete information and allow us to use it to communicate with you about the Services. Our communications to you using this information satisfy any requirements for legal notices.
1.3. You may try parts of the Services without an Account, with limited functionality and usage. Such use is for your personal, non-commercial evaluation only. Conversations started without an Account may be deleted at any time.
1.4. You can delete your Account at any time from your account settings. Deleting your Account permanently removes your conversations, files, documents and other content associated with it, subject to section 1.16 and our Privacy Policy.
1.5. You may not share your Account credentials with anyone else or make your Account available to anyone else. You are responsible for all activity occurring under your Account and agree to notify us immediately at hello@lekt.ai if you become aware of any unauthorized access to it.
1.6. You may need to accept additional terms to use certain Services. Those additional terms supplement these Terms for those Services and may change your rights or obligations, including your obligation to pay fees.
1.7. The Services are new and subject to change. We may introduce or remove features, adjust capacity, storage or usage limits, roll out new Services or discontinue existing ones. We reserve the right to modify, suspend or terminate the Services or your access to them. If these actions significantly affect your use of the Services, we will strive to notify you in advance, except where we act to address security, performance or trust and safety issues.
1.8. We may revise and update these Terms, for example (1) to reflect changes in the Services, such as when we add or remove features or update our pricing, (2) for security or legal reasons, or (3) to promote safety or prevent abuse. We will post the updated Terms on this page and update the effective date. Where a change materially affects your rights or negatively affects your use of the Services, we will notify you by email at least 30 days before it takes effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the change, you may terminate your subscription before the effective date and we will refund any prepaid fees for the unused period.
1.9. We may post supplemental terms or guidelines for specific Services or features ("Supplemental Terms"). If these Terms conflict with Supplemental Terms, the Supplemental Terms govern for the applicable Service.
1.10. You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time without notice if:
1.10.1. we believe that you have materially breached these Terms;
1.10.2. we must do so in order to comply with applicable law; or
1.10.3. immediate suspension or termination is necessary for security reasons and therefore we cannot provide notice.
1.11. We may also delete your Account if it has been inactive for more than a year and you do not have a paid plan. We will notify you at your Account email address before doing so.
1.12. If we terminate your access to the Services due to a material breach of these Terms and you have a paid plan:
1.12.1. you will not be entitled to any refund; and
1.12.2. we may take further legal action against you and you may be responsible for our losses in relation to the violation of these Terms.
1.13. If you have a paid plan, we may terminate it at any time by giving you immediate notice in writing (email is sufficient). If we exercise this right for reasons other than your breach, we will refund you on a pro rata basis the fees paid for the unused part of the current billing period.
1.14. Upon termination of these Terms, a paid plan or your access to the Services, the rights granted to you under these Terms to access and use the Services immediately terminate, and we may at our option delete any Materials or other data associated with your Account.
1.15. Severability. Each section of these Terms operates separately. If any court or relevant authority decides that any of them is unlawful or unenforceable, the remaining sections remain in full force and effect.
1.16. No assignment. These Terms may not be transferred or assigned by you without our prior written consent. We may assign these Terms to an affiliate, or to a successor in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of our assets, and will notify you of any such assignment. You may terminate if you do not agree to the assignment.
1.17. Use of our brand. You may not, without our prior written permission, use our name, logos or other trademarks in connection with products or services other than the Services, or in any other way that implies our affiliation, endorsement or sponsorship. To seek permission, please email us at hello@lekt.ai.
1.18. Legal compliance. We may comply with governmental, court and law enforcement requests or requirements relating to the provision or use of the Services, or to information provided to or collected under these Terms. We reserve the right, at our sole discretion, to report information from or about you, including stored files, Prompts or Outputs, to law enforcement.
2. Acceptable use of the Services
2.1. You may access and use the Services only in compliance with these Terms and any guidelines or Supplemental Terms we may post on the Services (the "Permitted Use").
2.2. You may not access or use, or help another person to access or use, the Services in the following ways:
2.2.1. in any manner that violates any applicable law or regulation, including laws about exporting data or software to and from any country in the European Economic Area, Switzerland or other countries;
2.2.2. to develop any products or services that compete with the Services, including to develop or train any artificial intelligence or machine learning algorithms or models;
2.2.3. to decompile, reverse engineer, disassemble or otherwise reduce the Services to human-readable form, except where these restrictions are prohibited by applicable law;
2.2.4. to crawl, scrape or otherwise harvest data or information from the Services other than as permitted under these Terms;
2.2.5. to use the Services or Materials to obtain unauthorized access to any system or information, or to deceive any person;
2.2.6. to infringe, misappropriate or violate intellectual property or other legal rights (including the rights of publicity or privacy);
2.2.7. to generate, upload, store, distribute or share content that is illegal or prohibited under the laws of the United States, the European Union or Estonia, or under the laws that apply to you or to the people you share it with, including content that sexualizes minors or that promotes violence, terrorism, self-harm or hatred against any group;
2.2.8. to upload, store, distribute or share malware, viruses, spyware, ransomware, exploit code intended for unauthorized use, phishing pages, scams, fraudulent schemes, or any other content designed to harm, deceive or defraud people or systems;
2.2.9. to upload, store, distribute or share pirated or otherwise unlicensed copies of software, media, books, courses or other copyrighted works, or circumvention tools, keys or cracks for them;
2.2.10. to share, or to make available through a share link, any content that you do not have the right to distribute to the people who can open it, even where you hold a license that permits your own personal use of that content;
2.2.11. to access the Services through automated or non-human means, whether through a bot, script or otherwise, except where we explicitly permit it;
2.2.12. to circumvent usage limits, credit accounting, referral or promotional rules, for example by creating multiple Accounts;
2.2.13. to engage in any other conduct that restricts or inhibits any person from using or enjoying the Services, or that we reasonably consider exposes us, our users, affiliates or any other third party to any liability, damages or detriment of any type, including reputational harm; or
2.2.14. to abuse, harm, interfere with or disrupt the Services, including by introducing viruses or malware, spamming or overloading the Services, or bypassing any of our systems or protective measures.
2.3. Geographic restrictions. The Services are not offered in, and you may not access or use them from, (a) any country or territory that is subject to comprehensive sanctions or embargoes imposed by the United States, the European Union or the United Nations, including the parts of the Crimea, Donetsk, Luhansk, Kherson and Zaporizhzhia regions of Ukraine that are not controlled by the Government of Ukraine, or (b) any of the following countries: Afghanistan, Algeria, Bangladesh, Belarus, Benin, Cambodia, Cameroon, Côte d'Ivoire, Cuba, Egypt, Ghana, Haiti, Iran, Iraq, Kenya, Laos, Libya, Morocco, Myanmar, Nepal, Nigeria, North Korea, Pakistan, Russia, Senegal, Somalia, South Sudan, Sri Lanka, Sudan, Syria, Togo, Turkmenistan, Uganda, Venezuela, Vietnam, Yemen, Zimbabwe. You represent that you are not located in, ordinarily resident in or accessing the Services from any such country or territory, that you are not a person or entity named on a sanctions list maintained by the United States, the European Union, the United Nations or Estonia, and that you are not owned or controlled by such a person or entity. We determine your location from your IP address and other technical signals, and we refuse sign-up, sign-in, purchases and use without an Account from these locations and may suspend or terminate Accounts used from them. You may not use a VPN, proxy or other means to disguise your location in order to circumvent these restrictions. We may change the list of restricted countries and territories at any time by updating these Terms.
3. Prompts, Outputs and Materials
3.1. You may submit text, files, documents, spreadsheets, images, voice recordings and other materials to the Services for processing (we call these "Prompts"). The Services may generate responses, documents, spreadsheets, images and other content based on your Prompts (we call these "Outputs"). Prompts, Outputs and any other content you store in your Air9 workspace, including files you upload, are collectively "Materials".
3.2. Rights to and responsibility for Materials. You are solely responsible for all Materials, including the Prompts you submit, the Outputs you choose to generate, keep or use, files you upload to your File Cloud, documents and spreadsheets you create or import, and anything you make available to other people. You must ensure that you have all rights, licenses and permissions necessary for us to store and process such Materials in accordance with these Terms and for any sharing you choose to do, and that your Materials and your use of them will not violate these Terms or any laws or regulations applicable to them. We do not pre-approve Materials and are not responsible for them. As between you and us, and to the extent permitted by applicable law, you retain any right, title and interest that you have in your Prompts. Subject to your compliance with these Terms, we assign to you all our right, title and interest (if any) in Outputs. Outputs may not be unique, and other users may receive similar or identical Outputs.
3.3. Reliance on Outputs. Artificial intelligence and large language models are frontier technologies that are still improving in accuracy, reliability and safety. When you use the Services, you acknowledge and agree that:
3.3.1. Outputs may not always be accurate and may contain material inaccuracies even if they appear accurate because of their level of detail or specificity;
3.3.2. you should not rely on any Outputs without independently confirming their accuracy;
3.3.3. the Services and any Outputs may not reflect correct, current or complete information; and
3.3.4. Outputs may contain content that is inconsistent with our views.
3.4. Agent actions. The Air9 agent can perform actions on your behalf, such as creating, editing or deleting files in your workspace, searching the web, running code, and reading from or writing to third-party services you have connected. You are responsible for reviewing the actions you ask the agent to take and for any consequences of those actions in your workspace or connected services.
3.5. Our use of Materials. We use Materials to provide, maintain, secure and improve the Services. We do not use your Materials to train AI models, and we do not share them with AI model providers for training. Two exceptions apply:
3.5.1. If you provide feedback to us (through the Services or otherwise) regarding any Materials ("Feedback"), we may store and use the related conversation as part of your Feedback. You have no obligation to give us Feedback, but if you do, you agree that we may use the Feedback however we choose without any obligation or payment to you.
3.5.2. If your Materials are flagged for trust and safety review, we may review and analyze those Materials to detect and enforce violations of these Terms.
3.5.3. Scanning and review. By uploading, storing or sharing Materials you agree that they may be automatically scanned, for example for malware, known illegal content, copyright infringement signals and other violations of these Terms. Materials that you share with other people, that are made available through a share link, or that are reported to us may additionally be reviewed by our staff. We may remove or disable access to Materials, revoke share links and suspend or terminate Accounts that we reasonably believe violate these Terms, and we may report illegal content to the competent authorities.
3.6. Third-party AI providers. To generate Outputs, the Services send the relevant Prompts and conversation context to third-party AI model providers acting on our behalf. These providers are contractually bound to process this data only to provide the service to us and not to train their models on it. See our Privacy Policy for details.
3.7. Sharing. The Services let you share conversations, files, documents and spreadsheets with other people through share links or collaborator invitations. Anyone with a share link can access the shared content, and depending on the access level you choose may download it, save a copy or edit it, until you revoke the link or their access. You are solely responsible for everything you share, for choosing who can access it and with what rights, and for any content that people you have given edit access to add to it. You may not share, or link to, content that you are not entitled to distribute to the people who can open it (see section 2.2.10), even if you are entitled to use that content yourself. Shared content may be scanned and reviewed as described in section 3.5.3, and every shared page lets viewers report it to us. If you believe that content shared through the Services violates these Terms or your rights, use the report option on the shared page or contact us at hello@lekt.ai.
3.7.1. Public sharing. In addition to section 2.2, you may not share through a share link, publish or otherwise make available to anyone other than named collaborators in your workspace any of the following:
3.7.1.1. pornographic or sexually explicit content, or other content intended only for adults;
3.7.1.2. content promoting, advertising or facilitating gambling, betting, lotteries, casinos or similar games of chance;
3.7.1.3. content advertising or offering for sale weapons, ammunition, explosives, drugs or drug paraphernalia, tobacco, vaping products, alcohol, counterfeit goods, regulated financial products, cryptocurrency or token offerings, or investment schemes;
3.7.1.4. graphic violence, gore or cruelty to people or animals;
3.7.1.5. personal data of other people, such as contact details, identification documents, financial or health information, or private communications, published without their consent;
3.7.1.6. content that impersonates a person or organisation, or that presents itself as official content of a government body, company or brand without authorisation;
3.7.1.7. spam, link farms, automatically generated pages intended to manipulate search rankings, or pages whose main purpose is to redirect visitors elsewhere; or
3.7.1.8. deceptive or fraudulent content, including disinformation presented as fact, fake reviews or testimonials, phishing, and advance-fee, pyramid or get-rich-quick schemes.
3.7.2. We may remove or disable access to content that violates section 3.7.1, revoke share links and suspend or terminate Accounts without prior notice.
3.8. Technical limitations. Different plans have technical restrictions associated with them, for example a daily AI usage allowance, a number of credits, a storage quota or limits on file sizes ("Technical Limitations"). Current Technical Limitations are shown on our pricing page and within the Services. The daily AI usage allowance is not disclosed as a fixed figure: the amount of allowance each request consumes depends on the amount of work the AI model performs, which varies with the task, so we only display the percentage of the daily allowance that has been used.
4. Plans, credits and payment
4.1. The Services are available on a free plan and on paid plans that unlock enhanced features and higher limits (the "Benefits"). The exact Benefits of each plan are described on our pricing page before purchase. You can manage your plan from your account settings.
4.2. Fees. All prices, including subscription fees and the price of extra credits or storage, are shown to you before purchase. Prices are shown in US dollars or euro depending on your country. Where a displayed price includes VAT we say so; otherwise VAT and other applicable taxes are added at checkout. The final price shown on the checkout page before you confirm a purchase includes VAT and other applicable taxes, determined by the location you specify.
4.3. Billing. Lekt Software OÜ is the seller of every purchase. Payments are processed by Stripe (Stripe Payments Europe, Ltd. and its affiliates) under Stripe's terms and we never see your full card details. We issue an invoice and receipt for every charge and email them to the address on your account. If you purchase a subscription, extra credits or extra storage, you will provide complete and accurate billing information, including a valid payment method. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel, in the currency of your first payment. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you keep the Benefits until then. We may change subscription prices, including for existing subscribers. If a price change applies to your subscription, we will notify you by email at least 30 days before it takes effect, and the new price applies from the first renewal after that date. If you do not agree to the new price, you may cancel your subscription before it takes effect; otherwise, keeping your subscription after that date constitutes acceptance of the new price. If your payment cannot be completed, we may downgrade your Account or suspend your access to paid Benefits until payment is received. If you enable automatic credit refills, we will charge your payment method for the amount you chose whenever your balance falls below the threshold you set, until you turn the feature off.
4.4. Credits. Paid plans and credit purchases give you access to certain features within a certain amount of usage measured in credits ("Credits"):
4.4.1. Credits are not legal tender or currency; they are not redeemable, refundable or exchangeable for any sum of money or monetary value; they have no equivalent value in fiat currency; and they do not constitute or confer upon you any property right. Credits are non-transferable and may be used only in connection with the Services.
4.4.2. Credits are a way to measure and limit usage of the Services. Using AI features consumes Credits based on the amount of text, files, images and other data processed, the model used and the feature used. Some features have a fixed Credit cost.
4.4.3. Credit usage is calculated by automated means. The usage of each feature is displayed within the Services. Where the exact cost of an operation cannot be known in advance (for example because the length of an Output is not known before it is generated), we show an estimate and charge the actual usage.
4.4.4. Credits included in a subscription are valid for the billing period in which they are granted and expire at the end of that period. Credits purchased separately do not expire while your Account exists. Complimentary Credits, such as referral bonuses, promotional Credits or weekly refills, are a bonus provided at our discretion. They may have their own validity period, and we may change that validity period, reduce or withdraw them, or stop granting them at any time without prior notice and without your consent.
4.4.5. If you downgrade or cancel a paid plan, unused subscription Credits are forfeited at the end of the billing period. Purchased Credits remain available, but some features that require a paid plan may become unavailable.
4.5. Extra storage. Extra storage is purchased for a fixed number of months and does not renew automatically. If your stored content exceeds your storage quota after extra storage expires or after a downgrade, you will not be able to add new files until you free up space or increase your quota; existing files remain accessible. If your stored content remains above your storage quota for more than 6 months, we reserve the right to delete files of our choosing until your usage is within your quota.
4.6. Referrals and promotions. We may offer referral rewards, promotional codes and other benefits. These are subject to the conditions stated at the time of the offer, are for personal use only, and may be modified or withdrawn at any time. We may reverse benefits obtained through self-referral, multiple Accounts or other abuse.
4.7. Right of withdrawal. If you are a consumer in the European Economic Area or the United Kingdom, you have the right to withdraw from a purchase within 14 days without giving any reason. The Services are a service that begins immediately after purchase. By completing a purchase you expressly request that we begin providing the Services during the withdrawal period and acknowledge that, if you withdraw, you pay for the part of the Services provided until you told us, and that you lose the right of withdrawal once the Services you bought have been fully performed. If you withdraw, we refund the price less an amount proportionate to the Benefits used; for credits, the price of the credits you have spent. The 14 days run from your first purchase of a subscription, not from each renewal. Our Refund Policy explains how to withdraw and includes a model withdrawal form. To exercise this right, email us at hello@lekt.ai.
4.8. Refunds. Except as set out in sections 1.13 and 4.7, in our Refund Policy or as required by applicable law, purchases are non-refundable. We may nevertheless issue a refund at our sole discretion, for example if you are unsatisfied with the Services, but we do not guarantee or promise any such refund. Purchases made through a third-party app store are subject to that store's refund terms.
5. Responsibilities, disclaimers and ownership
5.1. Third-party services. The Services may involve or be associated with third-party content, services or integrations, including services you choose to connect to Air9. We neither oversee nor assume liability for any loss or damage resulting from your use of such third-party content, services and integrations, and we offer no guarantees or warranties regarding them. Using any third-party content, services or integrations is entirely at your own risk and is governed by the respective terms, conditions and policies (including privacy policies) that apply to them.
5.2. Software updates. We may provide either manual or automated updates to our software, including our apps (the "Air9 Software"), without prior notice to you. These updates may contain open-source software. In case of any inconsistency between these Terms and any other terms that apply to any part of the Air9 Software, such as open-source license terms, the other terms prevail for that specific portion and to the extent of the inconsistency.
5.3. Ownership. The Services are owned, operated and provided by us and, where applicable, our Providers. We and our Providers retain all our respective rights, title and interest, including intellectual property rights, in and to the Services. Other than the rights of access and use expressly granted in these Terms, these Terms do not grant you any right, title or interest in or to the Services.
5.4. No warranties. You may have certain legal rights regarding the Services, particularly if the Services do not match their description, are defective or are otherwise unsuitable for their intended use. Should you believe that any Services you have ordered are not in compliance with these Terms, please contact us at hello@lekt.ai. Aside from these legal rights, the use of the Services and Materials is entirely at your own risk. The Services and Outputs are provided "as is" and "as available" and, to the fullest extent allowed by applicable law, are offered without any warranties of any kind, whether express, implied or statutory. We and our Providers explicitly disclaim all warranties of fitness for a specific purpose, title, merchantability, accuracy, availability, reliability, security, privacy, compatibility and non-infringement, as well as any warranty implied by dealings, performance history or trade practices.
5.5. Outputs are not professional advice. Outputs may include incorrect or incomplete information and should not be relied on for any activity that can have significant consequences. Outputs are not medical, financial, legal or other professional advice and do not substitute professional experts, scientific or professional literature or official sources of information. Any information provided by AI models should be treated as an opinion, not as a fact or a direct call to action.
5.6. Backups. We take reasonable measures to protect your Materials. However, you are still responsible for keeping copies of Materials that are important to you.
5.7. Exclusions. To the extent permitted by applicable law, we have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity, loss of data or indirect or consequential loss.
5.8. Your rights. Nothing in these Terms affects your statutory rights, and we are under a legal duty to provide you with Services that conform to the terms applying to them. Advice about your statutory rights is available from your local consumer protection authority.
5.9. Limitation of liability. Our total liability to you for any loss or damage arising out of or in connection with these Terms, whether in contract (including under any indemnity), tort (including negligence) or otherwise, is limited to the greater of (a) the amount you paid to us for access to or use of the Services in the six months prior to the event giving rise to the liability, and (b) EUR 100. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for intentional misconduct or gross negligence, or for any other liability that cannot be limited or excluded under applicable law.
6. Disputes
6.1. Governing law and jurisdiction. These Terms are governed by Estonian law. Your access to and use of the Services, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by Estonian law and must be brought in a competent court in Estonia. However, if you are a consumer in the European Economic Area or Switzerland, you also benefit from the mandatory consumer protection provisions of the law of the country in which you reside, and you may bring proceedings in the courts of that country.
6.2. Alternative dispute resolution. If you are a consumer in the European Economic Area and we are unable to resolve a complaint with you directly, you may refer the dispute to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) through the Estonian Consumer Protection and Technical Regulatory Authority (ttja.ee) or to a similar dispute resolution body in your country of residence.
